Possibly. Selling on Etsy is still running a business, and the SBA says license and permit requirements depend on your activity and location, with zoning that can apply to home-based businesses. Depending on where you live, an Etsy seller may need a city or county business license, a DBA if the shop uses a name other than their own, and a state sales tax registration. ProfitDrawer's startup guides advise checking before your first sale; the SBA says registration usually costs under $300.
Etsy runs the marketplace, but your city, county and state still set the rules for your business. A checklist for a new shop:
- City or county. Ask the clerk's office whether you need a general business license or a home occupation permit to sell from home.
- Shop name. If your shop name is not your legal name, ask your state or county whether you must register it as a DBA.
- Sales tax. Ask your state revenue department whether you need to register, and how sales made through a marketplace are handled in your state.
- Product rules. Some products have their own federal rules; candles, for example, have CPSC guidance on wicks and labels. Food, cosmetics and children's products often need more checks.
- Federal licenses apply only to regulated activities such as alcohol.
Etsy income is taxable whether or not you receive a Form 1099-K, so record each order, fee and refund as it happens. See the related answers on Etsy taxes and Form 1099-K. General information, not legal or tax advice.
